Changes to deadline specification
The delivery date may be put back by the company if signed proofs and/or originating material are not received by the dates specified. If the same delivery date is required and signed proofs and/or originating material are not received by the dates specified, the company may adjust the estimated price accordingly and shall notify the school in writing of the change if requested.
Changes to product specification
In the event that the school changes the number of copies or the number of pages to be printed, or any other specification either shown or not shown in this agreement, the company may adjust the estimated price accordingly and shall notify the school in writing of the change if requested.
Advertising
The company may offer some assistance to the school with preparing or procuring advertising; however, any contractual arrangements regarding advertising shall be between the school and the advertiser, and the company shall not involve itself in the collection of payment or be liable in any way for such contracts.
Limits of liability
The school is responsible for the content of the product published, and undertakes not to supply illegal, offensive, or plagiarised material. The school agrees to indemnify the company against any claim or action regarding suitability or legality of content. The company reserves the right to refuse to print any material it deems unsuitable for school content or that contravenes copyright laws or that exposes the company to any liability in civil or criminal law.
Privacy and right to publish
The school shall be responsible for supply of all images and information, and any material accepted by the company shall be deemed to have been authorised for publication by the school. The company may show the products it produces for the purpose of selling its publishing services to other clients.
Care of material supplied
The company shall take all reasonable steps to handle with care all photographs, documents, computer files or other items supplied by the school for copying, scanning, or otherwise reproducing, and will return such items to the school within a reasonable time. However, the company shall not be liable for any damage to or loss of such items that may occur as a result of reproduction processes, through reasonable wear and tear, in storage, or in transit.
Photos and text supplied by the school
The company shall be entitled to retain copies of all originating material supplied by the school for the archival purposes.
Copyright and intellectual property
All original works created by the company including layout, artistic works and files used in the creation of original work are the property of the company. The school has exclusive rights to issue copies of the delivered product to the public.
Portfolio Use
The company may use images of the product (which includes photos and text supplied by the school) produced under this agreement for their own promotional/portfolio purposes.
